Conditions of Entry – Waiver and Risk Acknowledgement

General Entry Terms

  • Compliance: All guests must comply with staff instructions to ensure safety and enjoyment during Activities. Failure to comply may result in removal from the premises without a refund.

  • Image Use: You consent to the potential use of your image in promotional materials unless you submit a written objection.

  • Security Cameras: You acknowledge that security cameras are in use in public areas for safety purposes.

  • Pool Conduct: No jumping into the pools is permitted.

  • Respect for Others: Guests are expected to be respectful of other patrons.

  • Swimwear: Swimwear must be worn in the pools and in the sauna.

  • Age Requirement: Guests must be at least 16 years of age to enter the premises and use the facilities.

  • Cancellation and Rescheduling: Guests must provide at least 48 hours notice if they wish to cancel or reschedule a booking. Failure to provide the required notice will result in the session being forfeited, with no entitlement to a refund.

  • Late Arrivals: If guests or members arrive more than 15 minutes late to a booking, Plunge Bath House and Recovery Centre reserves the right to reduce the session time accordingly, without any refund.

  • Rescheduling Sessions: Guests may reschedule a bathhouse session if it’s more than 12 hours before the start time.

  • How to Cancel or Reschedule: To cancel and rebook your appointment, simply log into your account online through the booking platform, cancel your existing session, and re-book for your preferred time. Alternatively, feel free to email us at hello@plungebathhouse.com.au.

  • Health and Safety: We kindly ask that guests and members do not attend any sessions if they are feeling unwell, have cold or flu-like symptoms, are presenting with potentially contagious skin conditions, or have experienced diarrhoea within the last 48 hours.

  • Session Duration and Additional Charges: For 60-minute bathhouse bookings, guests are entitled to 60 minutes of bathhouse time, which includes changing. The session duration is fixed; if you stay past your allotted time, you will be asked to leave after your session ends.

  1. Acceptance of Terms
    By entering Plunge Bath House and Recovery Centre, you acknowledge and agree to abide by the conditions of entry, terms of access, and participation in our recreational activities. Your entry signifies your acceptance of these terms as set forth by Plunge Bath House and Recovery Centre.

  2. Acknowledgment of Risk
    By entering Plunge Bath House and Recovery Centre, you agree to the following conditions, under the mutual understanding that Plunge Bath House and Recovery Centre  grants you access and participation in the Activities:

    • You accept all risks associated with potential injuries or health issues that may arise from entering Plunge Bath House and Recovery Centre or participating in the Activities, including but not limited to slipping, temperature extremes, equipment failure, or the actions of other patrons.

    • Certain Activities may not be suitable during pregnancy. It is your responsibility to seek medical advice and obtain clearance before participating in any Activities while pregnant.

    • You affirm that you are free from any existing injuries or health conditions that could be aggravated by participation.

    • Your entry and participation in any Activity at Plunge Bath House and Recovery Centre are done voluntarily and at your own risk.

    • Plunge Bath House and Recovery Centre, at your expense, may take necessary measures for your safety in case of injury or health issues while on the premises, including emergency medical care and ambulance services, though they are not obligated to do so.

    • Any statutory consumer guarantees under the Competition and Consumer Act 2010 (ACL) are waived for issues covered by section 139A(3). If a guarantee is implied, Plunge Bath House and Recovery Centre's liability is limited to re-providing the services. This agreement does not affect your legal rights in cases of reckless conduct causing significant personal injury as defined by the ACL.

    • You agree to release and indemnify Plunge Bath House and Recovery Centre and its associates from any claims or liabilities arising from your presence at the facility or participation in Activities.

    • You agree to reimburse Plunge Bath House and Recovery Centre for any costs resulting from a breach of this agreement.

  1. Definitions:

    • "Illness" refers to any physical or psychological condition.

    • "Injury" includes any physical or psychological harm, including the aggravation, acceleration, or recurrence of a pre-existing condition.

    • "Plunge Bath House and Recovery Centre" refers to Plunge Bath House and Recovery Centre Pty Ltd and its personnel.

    • "Activities" include all services offered at Plunge Bath House and Recovery Centre, such as pool use, sauna, cold plunge, compression therapy, and other related services.

  1. By entering or participating in Activities at Plunge Bath House and Recovery Centre, you confirm that you understand and agree to these terms, recognise this as a liability waiver, and voluntarily consent to its provisions. These terms apply regardless of whether you have paid for entry.
